 PUBLIC NOTICE: KOGI STATE ELECTRICITY REGULATORY COMMISSION (KERC) Initiates Tariff Determination Process for Kogi Electricity Distribution Limited (KEDL)

 In exercise of the powers conferred upon it by the Kogi State Electricity Law 2024 and all other enabling laws and regulatory instruments, the Kogi State Electricity Regulatory Commission (KERC) hereby gives notice that it has commenced the statutory process for the determination of end-user electricity tariffs applicable to Kogi Electricity Distribution Limited (KEDL).
In furtherance of this mandate, the Commission has issued a Public Consultation Paper on the Proposed Tariff Determination Framework for the Kogi State Electricity Market. The proposed framework is anchored on the principles of the Multi-Year Tariff Order (MYTO) methodology, which adopts a building-block approach for establishing the revenue requirement of regulated utilities. Under this methodology, tariffs are determined on the basis of prudently incurred and efficiently managed costs, comprising: (i) return on capital to provide a fair and reasonable return on efficiently deployed regulatory assets; (ii) return of capital through depreciation to ensure orderly asset replacement and long-term network sustainability; and (iii) efficient operating and maintenance expenditure necessary for the safe, reliable, and continuous provision of electricity services.
The framework is designed to ensure cost-reflectivity, regulatory certainty, transparency, and financial sustainability of the licensee, while safeguarding consumer interests through disciplined regulatory oversight.
The Consultation Paper sets out the Commission’s proposed technical, operational, and financial assumptions; presents a critical review of data submitted by KEDL; and identifies specific issues on which stakeholder input is sought prior to the issuance of a final Tariff Order.
Accordingly, pursuant to the Commission’s Tariff Regulations and associated Guidelines, NOTICE IS HEREBY GIVEN to electricity consumers, licensees, investors, organized private sector groups, civil society organizations, and all interested stakeholders to review the Consultation Paper and submit written comments to the Commission.
